These Terms of Service (“Terms”) govern your access to and use of the PatientForms.io platform and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using PatientForms.io, you agree to these Terms of Service and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Terms

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 18 years old to use our services.

3. Acceptable Use

You agree to use PatientForms.io only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the platform in any way that violates applicable laws or regulations, including HIPAA.
• Attempt to gain unauthorized access to any part of the platform or its systems.
• Interfere with or disrupt the integrity or performance of the platform.
• Upload malicious code or content that could harm the platform or other users.
• Use the platform to collect, store, or process data in violation of applicable privacy laws.

4. HIPAA and Data Handling

PatientForms.io is designed to support HIPAA compliance for healthcare providers. If you use our platform to collect, store, or process protected health information (PHI), you acknowledge that:

• A Business Associate Agreement (BAA) may be required between your organization and PatientForms.io.
• You are responsible for ensuring your use of the platform complies with HIPAA and other applicable regulations.
• You will configure appropriate access controls for your staff and users.

5. Service Availability

We strive to maintain high availability of our platform but do not guarantee uninterrupted access. We may temporarily suspend access for maintenance, updates, or unforeseen circumstances. We will make reasonable efforts to notify you of planned downtime in advance.

6. Payment Terms

Paid plans are billed monthly or annually as selected. Prices are subject to change with 30 days' notice. Payments are processed securely through Stripe. Refunds are handled on a case-by-case basis.

7. Limitation of Liability

To the maximum extent permitted by law, PatientForms.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the platform.

8. Intellectual Property

The PatientForms.io platform, including its design, code, and content, is owned by PatientForms.io and protected by intellectual property laws. You retain ownership of the data you submit through the platform.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, for significant changes, by email. Your continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access to the platform if you violate these Terms. Upon termination, your right to use the platform ceases immediately. We will make your data available for export for a reasonable period following termination.
